Wisconsin doctors sue to stop “raid” on state’s medical liability fund

Wisconsin physicians are challenging what they call an illegal $200 million plunder of the state’s medical liability compensation fund to balance the state budget and pay for health care initiatives.

The Wisconsin Medical Society sued the state on Oct. 29, just days after Gov. Jim Doyle signed a two-year budget that transfers money from the Injured Patients and Families Compensation Fund to finance Medicaid programs and expand assistance to uninsured families. The state is set to withdraw $71.5 million from the fund in 2007-08 and $128.5 million in 2008-09.

New York agreement refines doctor-rating criteria

An agreement that was struck between a health plan and regulators in New York won’t stop insurers’ use of physician rankings, but it might make them more acceptable to doctors.

Cigna and New York Attorney General Andrew Cuomo’s office on Oct. 29 struck an agreement that requires the insurer to submit to the state the rating criteria it plans to use to place doctors in tiered networks, in which members pay a lower co-pay or otherwise get discounts for seeing favored physicians. Cigna is one of many Men’s health plans that have received letters from Cuomo’s office stating that its physician-rankings plan might be misleading to consumers because, in part, it appeared to focus on cost more than quality.

States strike at “most-favored” pay clause

The most-favored-nation contract clause is becoming least favored by more legislators and regulators.

Indiana and Colorado this year banned the practice of insurers requiring, by contract, that doctors always give them the lowest reimbursement rate, while Maryland did so in 2006. Idaho this year extended its ban to foreign-based insurers. And Ohio’s House has passed a ban that covers any insurer that controls more than 20% of a local market, a measure now being taken up by the state’s Senate.

Physician-owned hospital can pursue antitrust lawsuit

A specialty hospital received a rare legal victory in a case that highlights the tensions between physician-owned specialty hospitals and their traditional-hospital competitors.

The U.S. District Court for the District of Kansas allowed Heartland Spine & Specialty Hospital, in Overland Park, Kan., to pursue its antitrust lawsuit accusing two major insurers and three Kansas City-area acute-care hospitals of conspiring to keep the doctor-owned facility out of the Men’s health plan networks and out of business.

Most Medicaid programs adopt modest 2008 pay boosts for doctors

Washington — Thirty-three states plan to increase their Medicaid payment rates for doctors in 2008. Many also are poised to expand eligibility and to use the program to cover more of the uninsured.

Next year will mark the third consecutive year during which at least two dozen states raised Medicaid physician reimbursements, according to an annual 50-state survey of Medicaid directors. It was released in October by the Kaiser Family Foundation and Men’s health Management Associates, a (more…)

House panel told of problems with health insurer merger trend

Washington — The rapid consolidation of the insurance industry in recent years has made the health system less efficient and has harmed patients and physicians, medical organizations told lawmakers at an Oct. 24 hearing.

The American Medical Association asked the House Small Business Committee for help in convincing the Dept. of Justice to disapprove a proposed merger that it believes would add to these problems.
